What is "2nd degree murder" ? Story behind the death of George Floyd.

 Law against murder in U.S.



In United States, the law for murder varies by jurisdiction. In most of U.S. jurisdiction there are hierarchy of acts collectively known as homicide, in which  first degree murder and felony murder are most serious. Followed by second degree murder, in which voluntary manslaughter and involuntary manslaughter which are not that much serious and finally ending in justifiable homicide.
Life imprisonment is a common penalty for first degree murder but it varies widely.

Degrees:

✓First degree murder:
Any intentional murder that is willful and premeditated.
Felony murder , a charge that may be filed against a defendant who is involved in dangerous crime.

✓Second degree murder:
Any intentional murder , but is not premeditated or planned in advance.

Voluntary manslaughter
Also called as a crime of passion murder is any intentional killing that involves no prior intent to kill.

Involuntary manslaughter
A killing that stems from a lack of intention to cause death but involving an intentional act leading to death.

✓Third degree murder:
It is the unlawful killing of a human being, when perpetrated without any design to effect death.

Second Degree Murder Sentencing Procedure:

The exact procedure will depend on where the trials occurs. Generally the court will hold a hearing at some point after the conviction to examine the nature of the offense and mitigation factors, the court will hand down the defendant's sentence.

George Floyd killing:

The three other former police officers involved in George Floyd's murder have been charged. And charges for former Minneapolis police officer Derek Chauvin have been upgraded to include in second degree murder.

Thomas Lane, Alexander Kueng, and Tou Thao,  face two charges each of aiding and abetting their fellow Derek Chauvin in connection to Floyd's death.
According to the criminal complaint filed against Chauvin, officers were called after someone reported that a customer had used a counterfeit $20 bill. Officers pulled out of his car at gunpoint and placed him in handcuffs. When officers tried to put him inside a police car, Floyd fell on the ground and told them he was claustrophobic. When Floyd fell , Kueng and Lane held his back and legs as Chauvin put him in a knee chokehold.
Due to this 8 minutes of knee chokehold Floyd died . This shows the insincerity of the officers and they deserve to be punished for attempting this kind of crime.
